What is a contract for work?

A contract for work is a legal document whereby the client undertakes to pay the price to the contractor, and the contractor undertakes to carry out the specified work at their own expense. It is governed by Sections 2586-2635 of the Civil Code.

What is the difference between a contract for work and an employment contract?

A contract for work is agreed upon for a specific result (the work). An employment contract obliges an employee to work within an employment relationship. A contract for work does not have to be within an employment relationship.

Can a contract for work be concluded orally?

Yes, but for proof and clarity it is always better to have it in written form. A written agreement protects both parties.

What to do if the manufacturer fails to complete the work on time?

If the manufacturer fails to complete the work within the agreed timeframe, the client may demand a contractual penalty, an extension of the deadline, or termination of the contract. These details should be specified in the contract.

How long does the warranty for defects last?

The deadline for reporting defects is usually 30 days from acceptance of the work (§2630 OZ). The repair period is agreed in the contract; the warranty may last 6-24 months depending on the type of work.
